- También, se sancionarán penalmente los delitos contra la economía pecuaria.
La 59 Legislatura mexiquense aprobó reformas al Código Penal del Estado de México para tipificar como delito la asociación delictuosa y de pandilla, así como en el incremento de las penas a las agravantes del robo de mercancía transportada, a transporte público y a transeúnte.
La propuesta del titular del Ejecutivo estatal tiene el propósito de fortalecer la seguridad pública mediante la actualización del marco jurídico estatal, para garantizar la vigencia del estado de derecho y la protección de los derechos humanos de los ciudadanos al ofrecer a ministerios públicos y juzgadores mejores herramientas para actuar en el combate a estos delitos.
El dictamen, al que dio lectura el diputado José Isidro Moreno Árcega (PRI), establece el tipo penal de pandilla como “la reunión habitual, ocasional o transitoria de tres o más personas que sin estar organizadas con fines delictuosos cometen algún delito”, y respecto de la asociación delictuosa dice que es “la unión de dos o más personas para cometer ilícitos”.
En ambos casos, las penas se agravan si quienes entran en los tipos penales son o han sido servidores públicos o miembros de alguna empresa de seguridad privada.
Respecto del incremento de las penalidades, en el caso del robo de mercancías esto ocurrirá cuando el delito se cometa a bordo de un vehículo automotor, en la ejecución existan dos o más sujetos pasivos y haya reincidencia; lo mismo sucederá cuando se trate de robo a transporte público en sus diferentes clases y modalidades, incluyendo las de personal, de turismo o escolar.
Además, se establece la agravante del delito de robo cuando lo cometan personas que pertenezcan o hayan pertenecido a una empresa de seguridad privada; cuando se perpetre en contra de mujeres, niñas, niños, adolescentes o adultos mayores o contra transeúnte y exista reincidencia.
CASTIGARÁN PENALMENTE DELITOS CONTRA LA ECONOMÍA PECUARIA
En la misma sesión del Noveno Periodo Ordinario, presidida por el diputado Jorge Omar Velázquez Ruíz (PRI), el Pleno aprobó la iniciativa del legislador Rafael Osornio Sánchez para sancionar penalmente los delitos contra la economía pecuaria y garantizar la comercialización y el consumo de productos de origen animal de alta calidad sanitaria.
Las adiciones al Código Penal avaladas establecen disposiciones que tienden a la prevención y a un control más estricto, contribuyendo al desarrollo de un adecuado seguimiento del ganado.
El diputado Rafael Osornio leyó el dictamen por el que se establecen como delitos contra la economía pecuaria la introducción de ganado bovino, sin serlo, o su movilización con ánimo de comercialización sin cumplir con la normatividad aplicable.
Se impondrá una sanción de seis meses a dos años de prisión y de 50 a 100 días de multa a quien movilice ganado bovino declarada en cuarentena o utilice cualquier contaminante referido en la Ley Federal de Sanidad Animal; si la movilización es con fines de comercialización, se alcanzará una pena de uno a dos años de prisión y de 150 a 200 días de multa.
Además, a quien presente o pretenda documentar ganado bovino como nacido en una zona de baja prevalencia y acreditada en la entidad sin serlo, se le impondrán de dos a ocho años de prisión. En los casos de reincidencia las penas se incrementarán hasta en un tercio.
