El gobierno de Tlalnepantla es el legítimo propietario del predio de la colonia Bellavista

  • El bien inmueble forma parte del patrimonio municipal conforme a la escritura pública número 80,374 con fecha del 13 agosto de 1975, por lo que es  un bien inembargable, imprescriptible e inalienable.
  • El gobierno local siempre ha sido poseedor legítimo de dicho predio que está destinado para la satisfacción de un interés general en beneficio de todos los habitantes de esta ciudad.

El gobierno municipal de Tlalnepantla es legítimo propietario del predio ubicado en Circuito Museos Poniente, esquina con Museo Norte. Fraccionamiento Bellavista Satélite, según consta en la escritura pública número 80,374, pasada ante la fe del Notario Público Número 38 del Distrito Federal, del 13 de agosto de 1975, por lo que es un bien inembargable, imprescriptible e inalienable.

La consejera jurídica municipal, Clara Camacho Méndez explicó que al ser un bien que forma parte del patrimonio municipal, el Ayuntamiento está obligado a la defensa del mismo conforme lo establece incluso en la propia Constitución Política de los Estados Unidos Mexicanos, por lo que desde 2004 se han tramitado procedimientos administrativos comunes, relacionadas con el comercio informal en dicho predio.

Los supuestos afectados, encabezados por Adriana Domínguez hablan de que la actual administración los despojó de dicho terreno de 764.71 metros cuadrados, lo cual es falso, porque el propietario y poseedor del mismo es el H. Ayuntamiento.

Cabe señalar y ya que la escritura presentada por la contraparte  fue emitida en  Salina Cruz, Oaxaca, suscrita en de 1989,  para lo cual se solicitó a la Dirección General de Notarias de dicho  Estado la inscripción de la misma y los anexos del apéndice que constan en el documento.

La respuesta de dicha autoridad  es que la citada escritura pública se encuentra afectada de nulidad por varias razones, entre ellas, porque carece del sello y firma del notario y solamente se registran las de quienes suscriben sin los nombres de los mismos.

En dicho predio propiedad Municipal se desarrolla una obra pública de equipamiento urbano, consistente en la construcción de una casa de cultura para beneficio de los habitantes de esta ciudad.

Actualmente, dicho predio se encuentra en litigio ante el Juez de lo Civil, del Distrito Judicial de Tlalnepantla, en el cual el H. Ayuntamiento demanda la nulidad de la escritura pública presentada por los quejosos y también se ejercitan acciones de carácter penal.
